By downloading, installing, accessing, or using Cocktail Recipes To Go ("the App"), you agree to be bound by these Terms of Service ("Terms"). 4. User-Generated Content
The App allows you to create and share cocktail recipes, ratings, and other content ("User Content"). Ownership: You retain ownership of the User Content you create. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App. Your Responsibilities: You are solely responsible for your User Content. You represent that: - You own or have rights to the content you submit - Your content does not infringe third-party rights - Your content does not violate any laws - Your content is accurate and not misleading Prohibited Content: You may not submit content that: - Is illegal, harmful, or offensive - Promotes dangerous alcohol consumption - Infringes intellectual property rights - Contains personal information of others without consent - Is spam or commercial advertising - Contains malware or malicious code
5. Intellectual Property Rights
App Ownership: The App, including its design, features, code, and content (excluding User Content), is owned by Daniel Sogl and protected by intellectual property laws. Trademarks: "Cocktail Recipes To Go" and associated logos are our trademarks. You may not use these without our written permission. Third-Party Content: Some cocktail recipes in the App are sourced from TheCocktailDB (www.thecocktaildb.com). These recipes remain the property of their respective owners. Restrictions: You may not: - Copy, modify, or distribute the App - Reverse engineer or decompile the App - Remove copyright or proprietary notices - Use the App for commercial purposes without permission - Create derivative works based on the App
6. Subscriptions and In-App Purchases
Pro Subscription: The App offers a Pro subscription with additional features. Subscriptions are processed through Apple's App Store. Subscription Terms: - Subscriptions automatically renew unless cancelled - You can cancel at any time through your Apple ID settings - Cancellation takes effect at the end of the current billing period Payment Processing: - All payments are processed by Apple - We do not have access to your payment information - Billing inquiries should be directed to Apple Refunds: - Refund requests must be made through Apple - We do not process refunds directly - Apple's refund policies apply
7. Advertising
Display of Advertisements: Users who have not subscribed to our Pro plan will see advertisements within the App. Your Choices: - Subscribe to Pro to remove all advertisements - Control personalized advertising via iOS Settings > Privacy & Security > Tracking Third-Party Content: - Advertisements are provided by third parties - We do not control or endorse the content of advertisements - We are not responsible for products or services advertised - Clicking on advertisements is at your own risk
8. Prohibited Conduct
You agree not to: Security Violations: - Attempt to access accounts of other users - Circumvent security measures or access controls - Interfere with the App's operation - Transmit viruses or malicious code Misuse of Services: - Use the App for illegal purposes - Violate any applicable laws or regulations - Engage in fraudulent activities - Abuse our refund or support processes Harmful Behavior: - Harass, threaten, or harm other users - Post defamatory or discriminatory content - Impersonate others or misrepresent your identity - Collect data about other users without consent
9. Content Moderation
We may review User Content to ensure compliance with these Terms. 10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Cocktail Recipes: We do not guarantee the accuracy, safety, or suitability of cocktail recipes. Users should: - Verify ingredients and measurements - Be aware of allergies and dietary restrictions - Consume alcohol responsibly - Not rely on the App for professional bartending User Content: We do not endorse or verify User Content. User-submitted recipes may contain errors. Alcohol Consumption: We do not encourage excessive alcohol consumption. Please drink responsibly and in accordance with local laws.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including: - Loss of profits or revenue - Loss of data - Business interruption - Personal injury or property damage - Any damages arising from use of the App Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim. German Law: Under German law (BGB), liability for damages to life, body, or health and for intentional or grossly negligent conduct cannot be limited.
12. Termination
Termination by You: You may stop using the App and delete your account at any time through Profile > Account Settings > Delete Account. Termination by Us: We may suspend or terminate your access if you: - Violate these Terms - Engage in fraudulent or illegal activity - Harm other users or our services - Fail to pay subscription fees Effect of Termination: - Your license to use the App ends immediately - Your account and data will be deleted - You remain liable for prior violations - Provisions that should survive termination will remain in effect
13. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. Jurisdiction: - If you are a consumer in the EU, you may bring claims in your local courts - For all other users, exclusive jurisdiction is in the courts of Germany EU Consumer Rights: If you are a consumer in the European Union, you retain any mandatory consumer protection rights under your local laws.
